Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Hillchart, including our website, application, shared snapshot pages, APIs, and related services (collectively, the “Service”).
The Service is built, operated, and owned by CYTHERE, a simplified joint-stock company (SAS) registered in France (SIREN 101 103 323), with its registered office at 197 rue de Crimée, 75019 Paris, France. Company information is available at https://www.societe.com/societe/cythere-101103323.html.
By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Service
Hillchart is a project-tracking tool inspired by Shape Up hill charts. We provide features such as scope management, snapshots, timeline views, sharing, embeds, webhooks, and API access depending on your plan.
We may change, suspend, or discontinue parts of the Service at any time. We try to give reasonable notice for material changes that affect paid features you rely on.
Accounts and eligibility
- You must provide accurate account information and keep your credentials secure.
- You are responsible for all activity that occurs under your account.
- You must be at least 16 years old, or the minimum age required in your jurisdiction, to use the Service.
- You may not share account access in a way that violates these Terms or applicable law.
Acceptable use
You agree not to misuse the Service. For example, you must not:
- Break the law, infringe others’ rights, or upload unlawful, harmful, or abusive content.
- Attempt to gain unauthorized access to the Service, other accounts, or our infrastructure.
- Interfere with or disrupt the Service, including by automated scraping beyond permitted API use.
- Reverse engineer or copy the Service except where allowed by mandatory law.
- Use the Service to send spam, malware, or deceptive communications.
Your content
You retain ownership of the projects, scopes, snapshots, comments, and other material you submit to the Service (“Your Content”).
You grant CYTHERE a worldwide, non-exclusive license to host, store, process, display, and transmit Your Content solely to operate, secure, and improve the Service, including generating share links and embeds you request.
You are responsible for Your Content and for ensuring you have the rights needed to upload and share it.
Public sharing
The Service lets you publish view-only snapshot links and embeds. Anyone with a link may be able to see the snapshot content you included.
You choose what to share. CYTHERE is not responsible for how third parties use publicly shared links once you publish them.
Plans and payment
Hillchart offers a Free plan and a Pro subscription. Current plan limits and prices are shown on our website and in the app. We may change prices or plan features with reasonable notice where required by law; changes apply to future billing periods.
- Free — up to 2 active projects, Hillchart branding on shared links, no animated timeline, no shareable cycle summaries on public reports, and no webhooks or MCP/API access.
- Pro — unlimited active projects, animated timeline, shareable summaries on view-only links, webhooks, MCP/API access, and optional white-label branding on shared reports.
- Pro is billed monthly at $10 USD or €9 EUR (or the price shown at checkout) as a recurring subscription through Stripe. New subscriptions include a 14-day free trial; you can cancel before the trial ends to avoid charges.
- When you subscribe, you complete payment on Stripe Checkout. Your plan is activated after Stripe confirms payment. You manage renewals, payment method, invoices, and cancellation through the Stripe customer portal linked from Settings → Plan.
- Subscriptions renew automatically each billing period until you cancel. If payment fails, we may retry billing through Stripe and may downgrade your account to Free after reasonable notice.
- Fees are non-refundable except where required by applicable law. If you are a consumer in the European Union, you may have a statutory right of withdrawal for distance contracts; if you ask us to begin the Service immediately during the withdrawal period, you may owe a proportionate amount for the period used.
Intellectual property
The Service, including its software, design, branding, and documentation, is owned by CYTHERE or its licensors and is protected by intellectual property laws.
Except for the limited rights expressly granted in these Terms, no rights are transferred to you.
Third-party services
The Service may rely on or link to third-party providers such as Supabase (hosting and authentication), Stripe (payments), or analytics tools. Your use of those services may be subject to their own terms and privacy policies.
CYTHERE is not responsible for third-party services outside our reasonable control.
Disclaimer
The Service is provided “as is” and “as available”. To the fullest extent permitted by law, CYTHERE disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement.
Project tracking outputs are informational tools only. You remain responsible for your business, planning, and compliance decisions.
Limitation of liability
To the fullest extent permitted by law, CYTHERE will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from your use of the Service.
CYTHERE’s total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid CYTHERE for the Service in the twelve months before the claim, or (b) one hundred euros (€100), except where liability cannot be limited under applicable law.
Termination
You may stop using the Service at any time and may delete your account from Settings → Profile.
You may cancel a Pro subscription at any time through the Stripe customer portal; cancellation takes effect at the end of the current billing period unless applicable law provides otherwise.
We may suspend or terminate access if you materially breach these Terms, fail to pay applicable fees, create risk for other users or the Service, or if required by law.
Upon termination, your right to use the Service ends. Pro features may be disabled if your subscription ends. Provisions that by nature should survive will survive, including ownership, disclaimers, and limitations of liability.

Our Privacy Policy explains how we collect and use personal data. By using the Service, you also agree to that policy.

Governing law and disputes
These Terms are governed by French law, without regard to conflict-of-law rules.
If you are a consumer resident in the European Union, you may also benefit from mandatory protections of the law of your country of residence.
Unless mandatory law provides otherwise, disputes shall be submitted to the competent courts of Paris, France.
Changes to these Terms
We may update these Terms from time to time. We will post the updated version on this page and revise the effective date above.
If changes are material, we may provide additional notice in the Service or by email. Continued use after changes become effective means you accept the updated Terms.
